THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No.19600 of 2017 ORDER: (per SK,J) This writ petition was filed assailing the e-auction notice dated 11.05.2017 issued by the Corporation Bank proposing to hold the auction of the secured assets on 16.06.2017.

Smt. V.Dyumani, learned counsel for the respondent bank, states that the conditional order dated 16.06.2017, whereby the bank was directed not to confirm the sale, if any, held on 16.06.2017, was not complied with. She would further state that the auction came to naught for want of bidders.

In that view of the matter, as the challenge in this writ petition was only to the e-auction notice dated 11.05.2017, which did not materialise in an actual sale, we are of the opinion that the issue is rendered purely academic and does not warrant consideration on merits. The writ petition is dismissed on this short ground leaving all issues open. The petitioner is at liberty to avail appropriate remedies if and as and when a fresh cause of action arises.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
