HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.28507 OF 2016 ORDER:
The case of the petitioner is that he is the owner and possessor of land to an extent of Ac.2.21 cents in Survey No.917/2A of East Gundur Village of Gudur Mandal being the legal heir of late Magunta Dayakar Reddy and his wife Prameela. It is stated that Magunta Ranga Reddy had 5 sons namely 1)Magunta Chandra Sekhara reddy @ Masthan Reddy (died) 2)Magunta Madhusudhan Reddy 3) Magunta Jaganmohan Reddy 4) Magunta Damodar Reddy (died) and 5) Magunta Dayakar Reddy (died) (petitioner's father) and that the land to an extent of Ac.2.28 cents was purchased in the name of Magunta Dayakar Reddy being minor represented by his mother Magunta Venkata Subbamma from A.V.Reddy and Jayalakshmamma vide document No.1052/1962, dated 20.06.1962 in Survey No.917/2 of East Gudur Village. The petitioner's mother Magunta Pramilamma sold away an extent of Ac.0.
07 cents out of Ac.2.28 cents in Survey No.917/2 under registered sale deed bearing document No.1234/1994 dated 15.04.1994 to Magunta Jagan Mohan Reddy. Magunta Dayakar Reddy and his wife Pramilamma died leaving behind their only daughter i.e. petitioner herein. The petitioner has given the subject land to an extent of Ac.2.21 cents to his paternal uncle Magunta Jagan Mohan Reddy.
to an extent of Ac.2.21 cents as legal heir of her parents. It is also stated that the petitioner's name was mutated in the revenue records as enjoyer of the subject land. While so, when she noticed the name of Magunta Damodar Reddy who is the elder brother of petitioner's father in the 1-B register and Magunta Jagan Mohan Reddy, who is one of the Elder brother of her father was noted as enjoyer in the year 20062007 without there being any right title over the land of an extent of Ac.2.21 cents, the petitioner made application to the respondents 1 to 3 for corrections of the name of the petitioner in the 1B register as well as adangal. In pursuance to the application made by the petitioner the 3rd respondent conducted enquiry and submitted a report dated 25.02.
2016 to the 2nd respondent for necessary orders for the correction of the name in the revenue records and incorporating the name of the petitioner in respect of the subject land. On receipt of the said report, the 2nd respondent issued proceedings dated 18.04.2016 directing the 3rd respondent to incorporate the name of the petitioner in respect of subject land and the said proceedings became final. As the said direction of the 2nd respondent was not complied with by the 3rd respondent, the 2nd respondent again by order dated 15.06.2016 directed the 3rd respondent to implement the changes and report compliance as per the proceedings dated 18.04.2016. As no action is being taken, present writ petition is filed.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.
In view of the above facts and circumstances, the 3rd respondent is directed to take appropriate action in accordance with law in pursuance to the proceedings dated 15.06.2016 issued by the 2nd respondent after issuing notice to respondents 4 and 5.
Accordingly, the writ petition is disposed of. No order as to costs.
