THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22738 OF 2016 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for Home. With consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.

2. The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents 5 & 6 in interfering with the peaceful possession and enjoyment of the petitioner over the property i.e., House bearing No.2-64/2/1/9 in Plot Nos.20 and 21 in Sy.No.124/da admeasuring 400 square yards situated at NTR Nagar, Gopanpally Village, Serilingampally Mandal, Ranga Reddy District without there being any cause or concern as illegal, arbitrary and consequently, to direct respondents 2 to 6 not to interfere with the peaceful possession and enjoyment of the petitioner over the property mentioned above.

3. The grievance of the petitioner appears to be that respondents 5 and 6 are interfering with the peaceful possession and enjoyment of the petitioner over the property in dispute and are threatening her to vacate the premises, failing which to foist false criminal case against her.

4. Learned Government Pleader for Home submits that allegations made in the writ petition are all false and the respondents will not interfere with the possession and enjoyment

of the petitioner over the property in dispute except in accordance with law.

5. Having regard to the above, the Writ Petition is disposed of directing the respondents-police to be mindful of the limits of their jurisdiction in criminal law and not to interfere with any civil dispute. Needless to mention that the respondents shall not interfere with the possession and enjoyment of the petitioner over the property without following due process of law. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
