HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.359 of 2003 ORDER :
This writ petition is filed to declare that respondent No.2 has no power or authority to initiate recovery of arrears of salary from the petitioners and to declare that the show cause notice dated 01.01.2002 and consequential orders dated 04.03.2002 issued by respondent No.2 and notice No.B5/2029/2002-03 dated 16.11.2002 issued by respondent No.3 as illegal and arbitrary.
2. On 08.01.2003 this Court granted in W.P.M.P.No.478 of 2003 interim stay of all further proceedings on condition of the petitioners depositing 50% of the demanded amount within eight weeks from that day. After obtaining interim stay, petitioners have not evinced any interest in prosecuting the case. When this matter has come up on 09.11.2015, a request is made to grant two weeks time and accordingly time is granted. Again when the matter is listed on 26.11.2015, advocate for petitioners sought one week time and same is granted. Today advocate for petitioners again sought time in a routine manner. Therefore, I am not inclined to grant further time.
3. In spite of granting time twice on the request of advocate of petitioners, no interest is evinced in prosecuting the case.
4. Hence, this writ petition is dismissed for non-prosecution.
