THE HON'BLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.9847 OF 2021 ALONG WITH I.A.Nos.3 AND 4 OF 2021 COMMON ORDER:

This Criminal Petition is filed by the petitioners - accused to quash the proceedings in C.C.No.10837 of 2019 pending on the file of the XIII Additional Chief Metropolitan Magistrate, Nampally at Hyderabad, registered for the offences under Sections 498-A and 406 IPC and 3 and 4 of D.P.Act. 2.

During the pendency of the present Criminal Petition, the parties have compromised the matter and have filed I.A.Nos.3 and 4 of 2021 to permit them to enter into compromise, record the terms of compromise thereof and compound the offences by quashing the proceedings against the petitioners/accused in the said C.C.

Vide order dated 24.12.2021, this Court, after recording the submissions made by the learned counsel for the petitioners as well as respondent No.2, directed the parties to appear before the Secretary, Telangana High Court Legal Services Committee, Hyderabad, for their identification and directed the Secretary to submit a report by 05.01.2022. In compliance of the said order, the parties have appeared before the Secretary, Telangana High Court Legal Services Committee, and the Secretary has identified the parties with their respective Aadhar Cards and accordingly submitted a report dated 31.12.2021 to that effect. 4.

The parties herein have filed joint memo of compromise. The said joint memo of compromise and the report of the Secretary, Telangana High Court Legal Services Committee,

Hyderabad, are placed on record. The joint memo filed by the parties and the affidavits thereof would reveal that respondent No.2 - de facto complainant has filed a complaint against the petitioners - accused before the WPS, CCS, DD, Hyderabad and the same has been registered as Crime No.393 of 2018 for the aforesaid offences. After completion of investigation, the Investigating Officer has filed the charge sheet and the same was taken on file as C.C.No.10837 of 2019 on the file of XIII Additional Chief Metropolitan Magistrate, Nampally at Hyderabad, and that now she has entered into compromise with the accused and accordingly approached this Court for recording the compromise with the petitioners - accused. 5.

In view of the said report and also in view of the compromise entered between the petitioners and respondent No.2, I.A.Nos.3 and 4 of 2021 are allowed. Consequently, the Criminal Petition is allowed and the proceedings in C.C.No.10837 of 2019 pending on the file of the XIII Additional Chief Metropolitan Magistrate, Nampally at Hyderabad, are hereby quashed against the petitioners - accused Nos.1 to 3, subject to payment of an amount of Rs.5,000/- (Rupees Five Thousand Only) to the Telangana High Court Advocates' Association, Hyderabad, within ten (10) days from today, and file proof of the same into the Registry.

As a sequel, the miscellaneous petitions, if any, pending in the Criminal Petition shall stand closed.
