THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No. 41839 of 2015 ORDER:

Pursuant to order dated 06.01.2016, learned counsel for Visakhapatnam Port Trust has placed on record a List showing the suits filed against Visakhapatnam Port Trust by the petty shop keepers in the compound of Sree Mahalaxmi Theater.

Learned counsel for the petitioners submits that the 1st petitioner filed O.S.No.977 of 2015 before the I Additional Junior Civil Judge, Visakhapatnam; and the 2nd petitioner filed O.S.No.995 of 2015 before the Principal Junior Civil Judge, Visakhapatnam; however, the petitioners later sought permission to withdraw the suits, whereupon the Court below by order dated 17.12.2015 dismissed the suits as withdrawn by reserving liberty to the petitioners/plaintiffs to file fresh suits against the defendants after issuing mandatory notices under Major Port Trust Act. 3.

After making the above submission, learned counsel for the petitioners seeks permission to withdraw the writ petition with liberty to approach the trial Court as per law.

Permission to withdraw is accorded, with liberty as sought for. 5.
