THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.10819 of 2007 ORDER:

Petitioner challenges Section 4(1) notification Roc.No.S.W.G2/177/2007 dated 27.04.2007 issued under the Land Acquisition Act as illegal and unconstitutional.

2. On 24.05.2007, this Court granted interim stay of all further proceedings pursuant to notification impugned in the writ petition. The respondents filed WVMP.No.3188 of 2007 to vacate the interim order.

3. The Assistant Government Pleader places on record the instructions dated 31.08.2016 received from the second respondent. The instructions read thus:

"I wish to inform that since alternative was identified and acquired in Saripalli (v) of Narsapur Mandal, the land covered by W.P.No.10819/2007 is no more required. Hence the fact may be appraised to the Hon'ble High Court."

The statement is placed on record. The writ petition is disposed of accordingly. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs. ____________ S. V. BHATT, J September 1, 2016 DSK
