HONOURABLE SRI J USTICE A.RAMALINGESWARA RAO WRIT PETITION No. 15413 of 2009 ORDER:
This Writ Petition was filed challenging the action of respondents in trying to demolish the house of the petitioners without following the due process of law.
The petitioners state that they have been residing in the land belonging to the Government for several years and their request for regularization of their occupied house plots was considered by the Government by issuing memo dated 28.05.2009 and directed the District Collector, to consider the case of petitioners for regularization of their plots. The Government also, after calling for the report from the concerned authorities, fixed the market value of the land as per G.O.Ms.No.166, Revenue (Assn.Pot) Department, dated 16.02.2008. The petitioners state that they paid the total amount to the Government. While so, the respondents came to the houses of the petitioners and tried to demolish the same. Hence the present Writ Petition.
This Court by order dated 29.07.2009 while admitting the Writ Petition granted interim order directing the respondents not to demolish the houses of the petitioners without following the due process of law.
Even after lapse of seven years of filing the Writ Petition, no counter affidavit is filed by the respondents. In the circumstances, the Writ Petition is disposed of in terms of the interim order dated 29.07.2009 by directing the respondents not to interfere with the houses of the petitioners without following the due process of law. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
