THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11104 OF 2025 ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.5 seeking anticipatory bail in connection with Crime No.124 of 2025 of Veldanda Police Station, Nagarkurnool District. The offences alleged against the petitioner are under Section 103, 109 r/w.Section 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The facts of the case are that the petitioner along with other accused beat the husband of defacto complainant with sickle and stones, due to which the husband of defacto complainant received grievous injuries and died. Hence, a complaint was registered against the accused for the above offences.

Heard Sri B. Bhagath Sain, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner is A.5 and she is falsely implicated in this crime. Petitioner is aged about 77 years and except that she was

- 2 - present at the time of incident, there are no specific overt acts against this petitioner. Though the alleged offence is serious in nature, considering the age of petitioner, learned counsel requested to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that it is an offence under Section 103 of BNS and anticipatory bail is not maintainable. In fact all the accused have participated in the incident and according to the complainant all the accused attacked the deceased. As such, prayed this Court to dismiss this petition.

Having regard to the submissions made by both the counsel and the material placed on record, the petitioner herein is aged about 77 years and in support of her age, she has filed her Aadhar Card showing her date of birth as 1948. Considering that the petitioner herein is a woman aged about 77 years, this Court is inclined to grant bail to the petitioner subject to the following conditions :

i.

The petitioner/A.5 shall surrender before the Station House Officer, Veldanda Police Station, Nagarkurnool District, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on her executing a personal bond for Rs.25,000/- (Rupees Twenty five thousand only) with two sureties, for the like sum each.

The petitioner/A.5 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.5 shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
