HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.1809 of 2015 ORDER:

The petitioners, who are accused Nos.1 and 4 to 8, filed the present Criminal Petition under Section 438 Cr.P.C. seeking release in the event of their arrest in connection with Crime No.32 of 2014 of Hindupur Rural Police Station, Anantapur District, registered for the offences punishable under Sections 193, 199, 386, 389, 420, 423, 447, 468, 471 and 506 read with 34 IPC. Originally a private complaint was filed under Section 200 Cr.P.C. which was referred to police under Section 156 (3) Cr.P.C. A perusal of the material placed before the Court would show that earlier the petitioners filed Criminal Petition No.7866 of 2014 seeking quashing of investigation in the said crime. By an order dated 21.07.2015 this Court while disposing of the said petition, directed the police not to arrest the petitioners during the pendency of the investigation.

Learned counsel for the petitioners submits that though the charge sheet is not filed but the police are threatening the petitioners to arrest them, hence seeks anticipatory bail. When there is an order passed by this Court directing the investigating agency not to arrest the petitioners till investigation is complete, the apprehension of the petitioner is ill founded. The police may or may not file charge sheet. In view of the orders passed by this Court in Criminal Petition No.7866 of 2014 and as the charge sheet is not yet filed by the police, no orders need be passed in this petition.

Accordingly, the Criminal Petition is dismissed, leaving it open to the petitioners to avail the remedies available under law. ________________ C.PRAVEEN KUMAR,J 11.03.2015 gkv
