HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36960 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to direct the 2nd respondent to take appropriate action on the complaints of the 2nd petitioner dated 19.7.2016 and 29.9.2016.

Heard and perused the material available on record. 3.

It is stated in the affidavit that the 1st petitioner leased out the subject land to the 2nd petitioner. On 9.7.2016, respondents Nos.3 to 5 and their henchmen entered into the subject land and threatened the 2nd petitioner. In that regard, the 2nd petitioner lodged a complaint against them before the 2nd respondent on 19.7.2016. As there was no response from the 2nd respondent, the 2nd petitioner lodged another complaint on 29.9.2016. But no action was taken by the 2nd respondent so far. 4.

Considering the circumstances of the case and the averments made in the affidavit, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

"The 2nd respondent is directed to register the complaints lodged by the 2nd petitioner on 19.7.2016 and 29.9.2016, if they disclose any cognizable offence, and proceed in accordance with law. If the above respondent fails to register the complaints, the petitioners are at liberty to avail the remedies that are available under law."

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
