HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.8147 of 2019 ORDER:

The present criminal petition is filed seeking to recall nonbailable warrant issued against the petitioner on 05.12.2019 in C.C.No.413 of 2019 on the file of the XV Special Magistrate, Erramanzil, Hyderabad.

Heard and perused the material on record.

The petitioner/accused is involved in the aforesaid case registered for the offence under Section 138 of Negotiable Instruments Act, 1881. In the said case, trial was completed and the judgment was pronounced on 05.12.2019 finding the petitioner/accused guilty of the said offence. However, as the petitioner was called absent on 05.12.2019, NBW was issued against him.

In view of the reasons stated in the affidavit filed in support of the application and since the petitioner/accused was found guilty of the aforesaid offence and for hearing him on the quantum of sentence, NBW issued against him can be recalled.

The Criminal Petition is disposed of, with the following direction; The petitioner/accused is directed to surrender before the trial Court on 31.12.2019 as directed by the trial Court on 05.12.2019. Till such time, the warrant issued against the petitioner is suspended. 6.

Miscellaneous applications, if any, pending in this criminal petition stand closed.
