UMA DEVI Writ Petition No.28322 of 2017 Order: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) While the proceedings under challenge in the writ petition is the E-Auction notice dated 27.3.2017, with respect to the subject property belonging to the petitioner the auction of which is scheduled to be held on 7.9.2017, Sri Chetluru Sreenivas, learned counsel for the petitioner, would submit that it would suffice, instead of adjudicating the petitioner's claim on its merits, if this Court were to permit the petitioner also to participate in the auction; and submit his bid for the subject property.
When we asked him whether there is an embargo on the petitioner, who had guaranteed the loan extended by the respondentbank to the borrower, participating in the auction, Sri B. S. Prasad, learned Standing Counsel for the respondent-bank, would fairly state that it is open to the petitioner to participate in the auction. In the light of the submission of Sri B.S. Prasad, learned Standing Counsel for the respondent-bank, the writ petition is disposed of permitting the petitioner also to participate in the auction, and to submit his bid. The respondent-bank shall consider the petitioner's bid along with the other bids, in accordance with law. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
