THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.40217 OF 2015 O R D E R :

This writ petition is filed seeking a Writ of Mandamus declaring the action of the respondents in not awarding compensation to the petitioner, as illegal, arbitrary and sought for a consequential direction to the respondents to pay compensation of Rs.50 lakhs and appoint the petitioner under compassionate grounds.

Learned counsel for the petitioner contends that the petitioner's husband died of electric shock and after the demise of her husband, the petitioner had submitted a representation to the respondents seeking ex-gratia and compensation in terms of policy of the respondents. But so far, the respondents have not passed any orders on the said representation nor considered the case of the petitioner for grant of ex-gratia and compensation. Therefore, he contends that appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for grant of ex-gratia and compensation in terms of policy of the respondents.

Learned Standing counsel appearing for the respondents contended that respondents would examine the case of the petitioner in terms of the policy of the respondents and appropriate orders would be passed, if only petitioner submits a fresh representation. This Court, having considered the rival submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation staking her claim for grant of ex-gratia and compensation in terms of

the policy of the respondents issued vide proceedings dated 09.02.2018 within two weeks from the date of receipt of a copy of this order and upon such representation being received, the respondents shall consider the same and pass appropriate orders in accordance with law, in another eight (08) weeks thereafter. With the above direction, this writ petition is disposed of. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
