HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23485 OF 2016 ORDER:

The case of the petitioners is that though they have submitted explanation dated 13.07.2016 to the notice dated 21.04.2016 issued by the 3rd respondent, stating that the subject land is a private patta land as held by this Court in WP.No.14551 of 2011, the respondents without considering the explanation are trying to take further action. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.

Since petitioner has already submitted explanation to the impugned notice dated 21.04.2016, the 3rd respondent is directed to take the same into consideration and dispose of the revision entertained under Section 9 of the A.P.Land in Revenue and Pattedar Pass Books Act, 1971, after giving opportunity of hearing to the petitioner as well as other parties to the proceedings. Till then, no coercive steps shall be taken against the petitioner. With the above direction, the writ petition is disposed of. No order as to costs.
