M/S. Kakani Grama Rajaka Sangham v. The Assistant Director Of Fisheries
HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.2276 OF 2009 ORDER:
The relief sought for in this Writ Petition is to declare the action of the respondents in not paying compensation as directed by this Court in W.P.No.17576 of 2006 and batch dated 30.09.2008 as arbitrary and illegal.
The petitioner's contention is that, despite their representation 24.10.2008, they have not been granted compensation; this Court had passed an order in W.P. No.11612 of 2008 directing the Assistant Director of Fisheries to take steps to put the fishery rights in the tank to auction, and take further steps, in accordance with law; this Court had also noted the submission of the Rajaka Seva Sangam that it had invested the amounts towards fish seed; and had observed that, if that be so, it shall be open to the society to make an appropriate representation for payment of compensation to the concerned authorities.
The petitioner's grievance is that, despite submitting such a representation, no action has been taken by the respondents till date. As the earlier order of this Court permitted the petitioner to submit a representation which the respondents were directed to consider, suffice it if the Writ Petition is itself disposed of permitting the petitioner to submit a representation afresh; and, on such representation being filed, the respondents shall consider the same in accordance with law, and in the light of the earlier order passed by this Court, within three months from the date of receipt of the representation.
The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. No costs. _________________________________ RAMESH RANGANATHAN, ACJ Date: 11.08.2017.
