HON'BLE SRI JUSTI CE T. VI NOD KUMAR WRI T PETI TI ON NO.27735 OF 2019 ORDER:

The present writ petition is filed to declare the action of respondent No.4 in not granting house construction permission to the petitioner basing on the application of the petitioner dated 23.09.2019 as illegal and arbitrary.

Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayath Raj and Rural Development and Sri G.Narender Reddy, learned Standing Counsel for Gram Panchayath. 3.

Learned Standing Counsel for Gram Panchayat filed counter on behalf of respondent No.4 and the same is placed on record. 4.

It is submitted by the learned Standing Counsel for Gram Panchayath that the application made by the petitioner through online for grant of permission for construction of house has been reverted by the authorities on 13.12.2019 whereby the petitioner was called upon to submit the sketch map to locate the subject plot and Sy.No.746 in which the petitioner is claiming his plot No.745. Learned Standing Counsel has also drawn attention of this Court to paragraph No.4 of the counter affidavit wherein it is stated that existence of subject plot itself is doubtful since the sub-layouts called Chaitanya Nagar and Tirumalanagar were illegally made in the said survey numbers and there is an objection made by one A.Venkatesh claiming to have purchased the land to an extent of 47 and odd acres in Sy.No.739 to 742 which are part of Sy.Nos.739 to 749 of Ekashilanagar layout.

Having regard to the submissions made and since the authorities have reverted the application made by the petitioner, the petitioner is at liberty to comply with the objections as noted by respondent No.4 in order to have the application filed by the petitioner to be processed further. Upon the petitioner complying with the objections and furnishing the necessary documents as may be required by the authorities concerned for grant of construction permission, the authorities shall make an endeavour to issue permission, in accordance with law.

Accordingly, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
