THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3187 OF 2015 ORDER:

The present criminal revision case is filed by the petitioner challenging the order, dated 03.11.2015, passed in Crl.A.No.134 of 2015 by the Court of the Principal Sessions Judge, Kurnool, whereby the Court below partly allowed the appeal modifying the order passed in Crl.M.P.No.2466 of 2015 in D.V.C.No.5 of 2015 by the Court of the Special Judicial Magistrate of First Class (for Prohibition & Excise), Kurnool, and reduced the interim maintenance from Rs.20,000/- (Rupees twenty thousand only) to Rs.10,000/- (Rupees ten thousand only) per month towards interim maintenance payable to the second respondent herein. Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner herein is unable to pay the interim maintenance amount as ordered by the lower appellate Court to the second respondent herein and as such, prays this Court to reduce the said amounts.

Considering the facts and circumstances of the case, the criminal revision case is disposed of with the following directions. (i) The petitioner herein is directed to pay 50% of the amount ordered by the lower appellate Court, i.e., Rs.5,000/- (Rupees five thousand only) per month to the second respondent herein towards interim maintenance on or before 10th of every succeeding month;

(ii) The petitioner is also directed to pay the arrears of maintenance amount calculating at 50% of the maintenance amount ordered by the Court below, within a period of three months from the date of this order; and (iii) The trial Court is directed to dispose of D.V.C.No.5 of 2015 as expeditiously as possible, preferably within a period of six months, without being influenced by order of this Court.

With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
