HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Writ Petition No.24141 of 2018 Order: (per V.Ramasubramanian, J.) The petitioner has come up with the above writ petition virtually challenging an amendment to G.O.Ms.No.109, Health, Medical and Family Welfare (C1) Department, dated 18-8-2016, introduced by way of amendment, through G.O.Ms.No.129, Health, Medical and Family Welfare (C1) Department, dated 25-7-2017.
2. Heard Mr. Dadi Radha Krishna, learned counsel for the petitioner.
3. The very same G.O.Ms.No.129, dated 25-7-2017, was challenged in a writ petition in W.P.No.27014 of 2017. Last year we rejected the challenge to the very same Government Order. This year we have gone one step further by directing the State of Telangana also to insert a similar clause, as found in Priority II(f), for admission to medical courses. What actually happened was that both the Governments sought the advice of the NCC Directorate as to how to arrange priorities. After getting the advice of the NCC Directorate, the State of Telangana issued G.O.Ms.No.14 implementing the NCC Directorate's priorities in respect of Technical Education but not in respect of Medical Education.
4. But the State of Andhra Pradesh implemented the list of priorities in respect of Medical Education under G.O.Ms.
No.129, dated 25-7-2017 and not in respect of Technical Education. We have directed both Governments to follow uniformity in the matter of priorities and even the NCC Directorate, by their last letter dated 07-7-2017, directed both Governments to follow the very same priority. The issue has already been sealed, by the previous orders. Hence, the writ petition is dismissed. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
