THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.27576 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that the Hon'ble Court may be pleased to issue a Writ, Order or Direction particularly a Writ of Mandamus declaring the impugned Order dated : 24-06-2017 issued by Telangana State Election Commission in No. 931/TSEC-L/2015-(2) by which the petitioner is made ineligible to contest the election to be held for any office under the provisions of Telangana Municipalities Act, 1965 for a period of 3 years on the ground he had not lodged the final accounts of election expenses within the stipulated time as arbitrary, illegal, incorrect and in violation of principles of natural justice and also contrary to the provision of Telangana State Municipalities Act, 1965 and consequently set aside the same and pass such other order or orders as are deemed fit and proper in the circumstances of the case."

Heard Sri T.P.Acharya, learned counsel appearing for the petitioner, learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent, Sri P.Sudheer Rao, learned standing counsel for respondents 2 & 3, Sri G.Praveen Kumar, learned standing counsel for the 4th respondent and learned Government Pleader for Revenue appearing for the 5th respondent. Perused the material available on record.

When the matter is called, it is submitted by learned counsel for both sides that the issue in the present writ

TA,J W.P.No.27576 of 2019 petition is squarely covered by the order, dated 19.07.2019, in W.P.No.14995 of 2019 of this Court. A copy of the same is filed along with writ material papers.

Following the said order and for the reasons stated therein, this Writ Petition is also allowed by setting aside the order impugned. There shall be no order as to costs. 5.

Office to enclose a copy of the order, dated 19.07.2019, in W.P.No.14995 of 2019 to this order.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
