This Writ Petition is filed with the prayer, which reads as under:

"... to issue a writ or order more particularly one in the nature of writ of mandamus declaring the inaction of the 2nd Respondent not to take any steps to dispose of the proceedings in SR No.11 (A), 56 (1) 1/89 order dated 05-02-2004 as remanded back for the fresh disposal by the Estate Abolition Tribunal cum District Judge at Srikakulam in T.S.No.1/2004, by order dt. 04-02-2013, as highly illegal, arbitrary, violation of Article 14, 16(g)(1), 21 and 300-A of Constitution of India and also violation of the principles of natural justice and consequential directions to the Respondent No.2 to dispose of the proceedings in SR No.11 (A), 56 (1) 1/89 order dated 05-02-2004 as remanded back for the fresh disposal by the Estate Abolition Tribunal cum District Judge at Srikakulam in TS.No.1/2004, by order dt.

04-02-2013 as expedite in the interest of justice.."

The case of the petitioners is that though the appellate authority, by order, dated 04.02.2013, passed in T.A.S.No.1 of 2004, has remanded the matter back to respondent No.2 for fresh disposal, no orders have been passed yet. Hence, the present Writ Petition is filed. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.

Without expressing any opinion on the merits, since it is stated that no orders are passed by respondent No.2 pursuant to the order, dated 04.02.2013, respondent No.2 is directed to dispose of the matter in accordance with law in terms of remand order after issuing notice to the parties to the proceedings.

With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs. __________________________ A. RAJASHEKER REDDY, J July 14, 2016 MD
