THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9557 of 2016 ORDER:

This Criminal Petition is filed by the petitioners-accused Nos.4 & 5, under Section 438 of the Criminal Procedure Code, seeking anticipatory bail in COR No.392 of 2016 on the file of Mahabubabad Prohibition & Excise Station, Warangal District, registered for the offences punishable under Sections 34(e) of A.P. Excise Act and 8(c) of NDPS Act.

The allegations against the petitioners are that they were found transporting black jaggery, alum and ganja illegally. Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged offences and they are falsely implicated in this case.

Learned Additional Public Prosecutor submitted that the petitioners are involved in other case of similar nature and hence, they are not entitled for anticipatory bail.

In view of the submission of the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioners.

Hence, the Criminal Petition is dismissed.
