HONOURABLE SRI JUSTICE S.RAVI KUMAR WRIT PETITION No.27486 OF 2003 ORDER:

This writ petition is filed to declare action of respondents in reducing the wages from Rs.102/- to Rs.94/- per day and also in reducing Agency Allowance from 25% to 20% and withdrawing Border Area Allowance as illegal, unjust, contrary to law, arbitrary and violative of provisions of Section 9-A of Industrial Disputes Act,1947 and Articles 14,16 and 21 of the Constitution of India.

Petitioners 1 to 5 are working as Mazdoors and 6th petitioner is working as Work Inspector in different places which are under the control of 4th respondent since more than 14 years continuously without interruption. Petitioners are working in agency area and according to them, as per the standard schedule rates, they are entitled for 25% agency allowance and as petitioners 4 to 6 are working in Boarder of Agency Area, they are further entitled for 15% of Boarder Agency Area allowance but the respondents reduced these rates unilaterally without giving any notice and that amounts to violation of Section 9-A of Industrial Disputes Act for abruptly reducing the wages and allowances.

Respondent filed counter disputing the contention of petitioners.

Heard arguments.

Advocate for petitioners submitted that the writ petition filed by other similar employee was allowed by this court and this matter is squarely covered by the orders of this court in W.P.No.22780 of 2004 dated 18-7-2005.

Learned Government Pleader appearing on behalf of respondents fairly submitted that the present cause is covered by orders of this court in W.P.No.22780 of 2004 dated 18-7-2005.

Learned Advocate for petitioners produced order copy of this court in W.P.No.22780 of 2004 dated 18-7-2005. and I have perused the same.

As the present subject matter is squarely covered by orders of this court in W.P.No.22780 of 2004 dated 18-72005, this writ petition is also allowed in terms of orders of this court in W.P.No.22780 of 2004 dated 18-7-2005. No costs.

As a sequel to the disposal of this writ petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
