THE HON'BLE DR JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.6252 OF 2017 ORDER:

Heard the learned counsel for the petitioners-accused Nos.2 to 4 and the learned Public Prosecutor for the State. Perused the record.

This Criminal Petition is filed to quash the proceedings against the petitioners-accused Nos.2 to 4 in CC.No.287 of 2016 on the file of the Special Magistrate, Cyberabad at Hayathnagar. The material on record reveals that there are allegations against the petitioners-accused Nos.2 to 4 constituting offences punishable under Sections 324 and 506 of the Indian Penal Code. There is another crime pending against the de facto complainant. Merely because there is another case registered against the de facto complainant, proceedings against the petitioners-accused Nos.2 to 4 in CC.No.287 of 2016 cannot be quashed. In the circumstances of the case, there are no merits in the quash petition.

At this stage, learned counsel for the petitioners submitted that he will move an application before the trial Court for discharge of the petitioners-accused Nos.2 to 4.

He is at liberty to do so.

With this observation, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending shall stand dismissed. _____________________________ (DR. SHAMEEM AKTHER, J) 27th July 2017 RRB
