Heard.
The petitioner alleges that she filed a private complaint in CFR.No.2691 before the Judicial First Class Magistrate, Bodhan against respondents 5 to 10. It is also stated that her husband also filed CFR.No.384 of 2015 before the same court against respondents 5 to 10.
The allegation in this writ petition is that the 3rd respondent has been summoning the petitioner and threatening the witnesses mentioned in CFR.No.384 of 2015 referred to above.
Learned Government Pleader has received instructions, which state that on 20-03-2015 one Smt.Marthala Kavitha, W/o.Ramana Reddy filed a complaint against the petitioner's husband and four others. Based on which, a case in Cr.No.93 of 2015 was registered on 20-03-2015 and the investigation in the said crime is pending. So far as the petitioner's allegations are concerned, it is stated that she already filed complaint in CFR.No.2691 of 2014 on 21-08-2014 before the Judicial First Class Magistrate, Bodhan. Based on which, a case in Cr.No.298 of 2014 was registered on 23-08-2014 against respondents 5 to 10. However, after investigation, final report as 'lack of evidence' is stated to have been filed before the jurisdictional court. The instructions further state that the petitioner's husband also filed a private complaint in CFR No.
384 of 2015, dated 25-02-2015 before the Judicial First Class Magistrate, Bodhan. However, no orders are received from the said Court with regard to the said complaint. Hence, the petitioner's allegation that police authorities are threatening the witnesses in the said C.F.R. is denied, as no such direction was received from the said court by the 3rd respondent. The instructions, therefore, state that except investigating Cr.No.93 of 2015, the police have not taken any action as alleged by the petitioner.
In view of the aforesaid averments, therefore, the allegations of the petitioner are not being substantiated.
