HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.33380 of 2014 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue an appropriate writ, order or direction more particularly a writ in the nature of mandamus declaring the action of the respondents in not taken any further action on the FIR No.135/2014 registered under 3(i)(x) of the SC/ST Prevention of Atrocities Act, 1989, even not act upon Rules 5 to 7 and 12 of the SC/ST Prevention of Atrocities Act, 1989 against the 6th respondent/accused as illegal, arbitrary, violation of the provisions of the 3(i)(x) of the SC/ST Prevention of Atrocities Act, 1989 and Rules 5 to 7 and 12 and violation of principle of natural justice and violation of Article of Constitution of India and contrary to settled principal of law consequently directing respondents to take necessary further action on FIR No.135/2014 registered under 3(i)(x) of the SC/ST Prevention of Atrocities Act, 1989 against the 6th respondent/accused."

Learned Government Pleader appearing for respondent Nos.1 to 5 informs the Court that pursuant to the registration of FIR.No.135 of 2014, investigation was completed and a final report was filed referring the case as 'false'.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. However, if the petitioner is having any objections to the final report, the remedy available to him is to file a protest application as per law before the Court concerned. No order as to costs.
