THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.36122 of 2015 ORDER:

The grievance of the petitioner was with regard to the proceedings dated 08.09.2015 of the Prohibition and Excise Superintendent, Saroornagar, Ranga Reddy District. Under the said proceedings, the authority suspended the licence of the petitioner in relation to his TFT Toddy Shop at Khanapur, Counter No.1, Manchal Mandal, Ranga Reddy District, with immediate effect as an interim measure pending enquiry and in the interest of public health. It is not in dispute that the authority has the power to initiate such a measure of suspension pending enquiry.

However, as Sri T.Amarnath Goud, learned counsel for the petitioner, complained that the enquiry may consume some time and in the meanwhile if the petitioner's licence is subjected to suspension it would cause him irreparable loss and injury, the learned Assistant Government Pleader for Prohibition and Excise was asked to get instructions in the matter.

Today, the learned Assistant Government Pleader for Prohibition and Excise informed this Court that the enquiry in the matter has already concluded and proceedings dated 30.10.2015 have been issued by the Prohibition and Excise Superintendent to the petitioner proposing cancellation of his licence and asking him to show cause as to why the same should not be effected. In the light of the aforestated developments, the petitioner's apprehension that the enquiry may go on for a long time to his detriment stands settled. The writ petition is accordingly closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
