THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.28820 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The petitioners herein are aggrieved by the order passed by the Joint Collector-II, Ranga Reddy District, Lakdi-ka-pool, Hyderabad, the 2nd respondent, rejecting the appeal filed by them on the ground that no application for condonation of delay was filed though the appeal was preferred against an order of the Revenue Divisional Officer, Chevella, dated 13.12.1997.

Learned counsel for the petitioners, however, states that the petitioners have filed an appropriate application on 01.07.2015 for condonation of delay and therefore seeks reconsideration of the said application and the appeal on merits.

In view of the fact that subsequent to the impugned order the petitioners have filed an application for condonation of delay on 01.07.2015, it would therefore be appropriate that the 2nd respondent is directed to consider the said application and examine the appeal filed under Section 24 of the Andhra Pradesh (Telangana Area) Abolition of Inams Act, 1955 afresh. The impugned order rejecting the appeal on threshold is therefore set aside and the matter shall stand remitted to the 2nd respondent for fresh consideration of the appeal along with the application for condonation of delay stated to have been filed by the petitioners on 01.07.2015. Office of the 2nd respondent shall return the original appeals for compliance to the learned counsel for the

petitioners. It is made clear that the 2nd respondent is free to examine the matter afresh and pass appropriate orders in accordance with law after considering the petitioners' application. With the above directions, the Writ Petition is allowed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
