HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44783 OF 2016 ORDER:
The present writ petition is filed by the petitioner seeking to declare the action of the 2nd respondent in issuing proceedings, dated 07.11.2012, reducing the amount payable to the petitioner pursuant to the indent order, dated 01.02.2012, for supply of material for utilization in Sri Sammakka Saralamma Jathara, Medaram, 2012 for supply of UPS, Batteries etc., for photocopy machine, and stationery, as arbitrary and illegal and consequently, direct the respondent to pay the balance bill amount to the petitioner.
Heard and perused the material available on record. When the matter is taken up for hearing, learned Government Pleader for Social Welfare submitted that on the earlier round of litigation, the petitioner filed a writ petition in which he also filed a contempt case and the said contempt case was closed with a direction to the petitioner to approach the appropriate forum for remedy, if there is any claim of amount from the respondents, and the present writ petition is filed for the same set of facts. Learned counsel for the petitioner also agreed that earlier the petitioner has filed a writ petition for the same relief.
In view of the above, this Court is of the view that the present writ petition is not maintainable and the same is liable to be dismissed. Accordingly, the Writ Petition is dismissed. However, the petitioner is at liberty to approach appropriate forum for the redressel of his grievance. No order as to costs.
