HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CIVIL MISCELLANEOUS APPEAL No.97 of 2016 JUDGMENT:

Heard learned counsel for the appellants.

This Appeal is filed by the proposed plaintiffs against the order dated 30-07-2014 in I.A.No.460 of 2014 in O.S.No.353 of 2006, wherein the Court below dismissed the application filed to set aside the abatement against the 1st plaintiff by condoning the delay in filing the legal heir application.

Though notices are served to the respondents, there is no opposition from the respondents. In view of the orders passed in C.R.P.No.3822 of 2014, this appeal is also liable to be allowed.

Accordingly, the Appeal is allowed. The impugned order is set aside. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 27-01-2016 Note:
