THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.7658 OF 2017 ORDER:

This writ petition is filed challenging the action of respondent Nos.2 and 3 in not releasing the final layout as well as the mortgaged plots in favour of the petitioners. 2.

It is the case of the petitioners that they have submitted a plan to respondent Nos.2 and 3 seeking a layout in respect of their land in Sy.No.51 of Kowkur Village, Malkajgiri Mandal, Ranga Reddy District, and the same was approved vide File No.410/MP2/PLG/HMDA/2010, dated 14.08.2013. Pursuant to the same, an Agreement and Deed of Mortgage was executed between the petitioners and respondent Nos.2 and 3 vide document No.4653 of 2013 dated 27.06.2013. Thereafter, though the petitioners fulfilled all the conditions, as envisaged, and did not violate any of the conditions, respondent Nos.2 and 3 did not release final layout as well as the mortgaged plots without there being any reason.

Heard learned counsel for the petitioners and learned Standing Counsel for respondent Nos.2 and 3.

In the facts and circumstances of the case, this writ petition is disposed of directing respondent Nos.2 and 3 to release the final layout as well as mortgaged plots bearing Nos.10 and 11 admeasuring 752.52 square meters or 900 square yards in Sy.No.30(P) of Gandipet Village, Rajendra Nagar Mandal, Ranga

Reddy District. Miscellaneous petitions pending, if any, shall stand closed. No costs.
