THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 10515 of 2015 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for the respondents 1 to 3 and learned counsel for the 4th respondent.
2. This writ petition was filed challenging the appointment of the 4th respondent pursuant to a notification dated 01.01.2015 on the ground that the 4th respondent, though was involved in a criminal case, was appointed as a fair price shop dealer, where the petitioner also appeared for the written test and interview. The learned counsel for the 4th respondent produced before this Court a copy of order of acquittal passed by the Judicial Magistrate of First Class, Penukonda, on 24.04.2015 acquitting the 4th respondent in C.C.No.259 of 2014. Though the 2nd respondent has not properly conducted the enquiry at the time of appointment of the 4th respondent, in view of the acquittal of the 4th respondent in the criminal case, this Court is not inclined to entertain the present writ petition and the same is accordingly dismissed.
3. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
