THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10277 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.572 of 2023 on the file of Keesara Police Station, Rachakonda, registered for the offences under Sections 376 (2) (n), 417 and 493 of IPC and Section 5(l) r/w. 6 of POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioner was arrested on 28.08.2023 on the basis of the complaint filed by the victim girl alleging that this petitioner was following her. However, they started talking with each other on phone. In the month of June, 2023, while she was going to her house, after completion of her work as maid servant, this petitioner followed her and took her to a public park and had sex forcibly. Thereafter also he had sexual intercourse on different occasions.

Learned Additional Public Prosecutor on instructions would submit that the investigation is complete and charge sheet is already filed.

Keeping in view that the investigation is complete, the petitioner can be granted regular bail, subject to following conditions:- i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of III Additional Metropolitan MagistrateMalkajgiri District. ii) The petitioner/Accused after release shall appear before the concerned Court on every date of hearing. iii) In the event of petitioner trying to contact the victim girl or her relatives in any manner, the Police are at liberty to seek cancellation of bail granted to the petitioner.

(iv) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
