THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.19738 OF 2016 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for Home. With consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.

2. Since this Court is not going into the merits of the case, giving notice to the unofficial respondent may not be necessary.

3. The present Writ Petition came to be filed with the following prayer:

"to issue an appropriate writ, direction or order, more particularly one in the nature of Writ of Mandamus, declaring that the 5th Respondent Association, deserves elections with utmost despatch and it is further consequentially prayed that this Hon'ble Court may be pleased to direct the respondent Nos. 1 to 4 to forthwith hold elections to the said Association, to achieve, the object sought to be achieved, through the said Associations, to ensure the welfare of the Police Officers, in the light of the provisions of the RSA Rules, 1962 as amended by RSA Rules in G.O.Ms.No.264, GA(SW) 2001, G.O.Ms.No.539 Home (Police-C) Department dated 06.08.1979 and G.O.Ms.No.113 Home (WNT) Department dated 16.06.2008."

4. Though various grounds are raised in the writ petition, learned counsel for the petitioner mainly submits that the action of

the respondents in not considering the representation dated 18.01.2016 made to the 2nd respondent - Director General of Police seeking holding of elections of Telangana State Police Association is illegal and arbitrary.

5. Learned Government Pleader for Home opposes the same, but however, submits that if the representation is still pending consideration, the authorities will deal with it, in accordance with law.

Without going into the merits of the case, the Writ Petition is disposed of directing the 2nd respondent to consider the representation dated 18.01.2016 made by the petitioner for holding the elections to Telangana Police State Association, in accordance with law, as early as possible, preferably within a period of four

(04) weeks from the date of receipt of a copy of this order. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
