OFFICENOTE 30.04.2015 UDPR,JCrl.P.M.P.No.4195 of 2015 The defacto to i-order folder before making corrections if a complainant and her counsel Smt.Madhavi Priya Mantena are present. A1 to A5 and their counsel Sri Rajagopallavan Tayi are present. On the report given by defacto complainant, the police of WPS, Kurnool registered a case in Cr.No.80 of 2012 against A1 to A5 for the offences under Sections 506, 498A, 420 r/w 34 IPC and Section 4 of Dowry Prohibition Act and investigation is reported to be pending.

While so, defacto complainant and accused along with their respective counsel present in Court today and submitted that at the intervention of elders they have amicably resolved all their disputes and as per the settlement, complainant and A1 living separately and proposed to obtain divorce by mutual consent and further it was agreed that the complainant will have the custody of her two minor daughters and A1 has taken care of maintenance claim of complainant and her two minor daughters and as per the agreement, A1 agreed to give four plots and flat mentioned in the compromise petition to defacto complainant and her daughters and get those properties registered in their favour today and in view of the settlement, the defacto complainant has no objection for quashment of the proceedings against the accused and therefore, this Court may be pleased to accord permission to compound the offence and compromise the issue and quash the proceedings in the interest of justice.

Having regard to the above submission and in view of the fact that it is a matrimonial matter wherein the parties have amicably resolved all their disputes and considering that no useful purpose will be served even if investigation is ordered to be continued since parties have compromised the issue, and following the decision reported in Gian Singh vs. State of Punjab and another (2012) 10 SCC 303 this petition is allowed and permission is accorded to the parties to compound the offence in terms of joint compromise memo filed by them. _________30.04.2015MurthyCrl.PM.P.No.4196/2015 in Crl.P.No.3911 /2015andCrl.P.No.3911 of 2015 Both the petitions are allowed.
