THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.481 of 2017 ORDER:

The petitioners/A.1 and A.2 filed the present application under Section 438 Cr.P.C. to grant pre-arrest bail in the event of their arrest in connection with Crime No.376 of 2016 of Taluk Police Station, Ongole, Prakasam District, registered for the offence punishable under Section 420 IPC.

After arguing the matter for a while, learned counsel for the petitioners seeks a direction from this Court to permit the petitioners to surrender before the Magistrate having jurisdiction over the area and move an application for grant of bail, which shall be decided on the same day without going into the merits of the case, after issuing notice to the Public Prosecutor.

Acceding to the request of learned counsel for the petitioners, I deem it appropriate to permit the petitioners to surrender before the Magistrate having jurisdiction over area and move an application for grant of bail, in which event, the Magistrate is directed to decide the same on the same day, after issuing notice to the Public Prosecutor. 4.
