This writ petition is filed challenging the action of the respondents 2 to 5 in interfering with the civil disputes and thereby not allowing the petitioners to enter the land and trying to evict the petitioners from the peaceful possession and enjoyment of the agricultural land to an extent of 15.38 guntas in Sy.No.712 situated at Maddika Village, Bheemaram Mandal, pending dispute between the petitioners and respondent No.6 in OS.No.364/2009.
Heard learned counsel for the petitioners.
Learned Assistant Government Pleader for Home produced written instructions stating that basing on the complaint of the 6th respondent a case in Crime No.63/2018, dated 16.06.2018, was registered against the petitioners 2 and 3 and others; that after completion of investigation charge sheet is also filed and the same is numbered as CC.No.240/2018 which is pending trial; that the respondent No.4 never interfered with the civil disputes or tried to dispossess the petitioner; that except registering the FIR and investigation, respondent No.4 did not interfere or try to dispossess the petitioner from the subject lands.
On the other hand learned counsel for the petitioners submits that when the petitioners were granted injunction in the civil suit filed by them in OS.No.364/2009, question of trespassing as alleged by the 6th respondent, does not arise; and that the petitioners are not parties in the suit in OS.No.41/2011 filed by the 6th respondent.
Recording the submissions of the learned Assistant Government Pleader, the writ petition is disposed of. However, the respondent police shall not interfere with the civil disputes pending between the petitioner and third parties in respect of the subject land. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 20.07.2018 t k.
