The present writ petition is filed to declare the action of the respondents in interfering with the possession of the petitioner's land situated in Survey No.253/A/2 situated at V.

Venkatayapalem Revenue Village, Raghunadhpalem Mandal, Khammam District, as being illegal, arbitrary and unjust.

Heard Smt. K. Udaya Sri, learned counsel for the petitioner and the learned Government Pleader for Home appearing for the official respondents.

While denying the writ averments with regard to the official respondents' interference with the possession of the petitioner's land, the learned Assistant Government Pleader for Home, on written instructions dated 16.12.2019, a copy of which is placed on the record of this Court, submits that there are four cases registered relating the land in Survey No.253/A/2, vide Crime Nos.131, 232, 234 and 268 of 2019 of Raghunathapalem Police Station, and the respondent authorities except investigating into the above said cases, never interfered with the civil disputes at any time. Rao and others that the said complainants purchased plots from one T. Suryanarayana in Survey No.253/A through documents executed in the year 1994, the Investigating Officer addressed a letter to the Tahsildar, Raghunadhapalem Mandal regarding the details of ownership of the land in Survey No.253/A/2, to which the Tahsildar gave reply stating that one P.

Venkateswarlu has sold the land to T. Suryanarayana. Whereupon, further letter was addressed to the Registrar, Kusumanchi regarding registration of the above land and it discloses that T. Suryanarayana has made the land in plots and sold it to many persons. In the written instructions, it is further stated that as per the report of the Tahsildar, there are no records showing that lands belong to the petitioner and also as per the Encumbrance Certificate issued by the Sub-Registrar Office, Kusumanchi, the said land does not belong to the petitioner. The petitioner having regard to the above cases being registered has come up with the present writ petition to bring pressure on the police officials investigating into the four crimes that are registered in respect of the land in Survey No.253/A/2.

In view of the above submissions by the learned Assistant Government Pleader for Home, no furthers orders are required to be passed in this writ petition, except observing that the authorities while investigating into the above crimes registered shall act in accordance with law.

Accordingly, the writ petition is closed. However, there shall be no order as to costs.
