THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9957 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.1 & 3 seeking bail in the event of their arrest in connection with Crime.No.58 of 2023 on the file of Pochampally Police Station, Yadadri-Bhuvanagir District, registered for the offences under Sections 307, 406, 464, 467, 468, 470, 471, 474, 506 and 120b r/w. Section 34 of IPC. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

A private complaint was filed by the de-facto complainant alleging that in respect of property, these petitioners have colluded and fabricated certain documents to claim ownership. There were disputes regarding the said property. Accordingly, these petitioners and others formed unlawful assembly and attacked the de-facto complainant.

However, on instructions, learned Additional Public Prosecutor would submit that no injuries were received by the de-facto complainant.

A bare reading of the complaint would reveal that the disputes are in relation to the property and the subject matter is of civil jurisdiction, 6.

Keeping in view the circumstances of the case, these petitioners can be granted the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos.1 & 3 are directed to surrender before the Station House Officer, Pochampally Police Station, Yadadri-Bhuvanagiri District, on or before 19.10.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioners/Accused Nos.1 & 3 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of eight weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos.1 & 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
