THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.13205 OF 2016 ORDER:
It is the case of the petitioner that his father was the fair price shop dealer in respect of Shop No.20 of Rampur Village, Maripeda Mandal of Warangal District. He died on 22.05.2015. Hence, the petitioner approached the 3rd respondent requesting to consider his case for appointment as fair price shop dealer on compassionate grounds and the 3rd respondent also recommended to consider the case of the petitioner to the 2nd respondent vide proceedings in R.C.No.A/942/2015 dated 25.06.2015. However, the 2nd respondent vide orders in Rc.No.C/2278/2015 dated 05.08.2015 rejected the case of the petitioner on the ground that the petitioner has crossed the upper age limit. Aggrieved over the same, present writ petition has been filed by the petitioner.
Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.
Though initially petitioner's counsel contended that rejection has been made by reference to G.O.Ms.No.52 dated 18.12.2008, after arguing for some time, he had given up the said argument and conceded that clause 6 (4) of G.O.Ms.No.4 dated 28.02.2014 prescribes age limit applicable even for appointment on compassionate grounds.
In that view of the matter, admittedly petitioner is not eligible for appointment as fair price shop dealer in view his crossing the upper
age limit. As such, the impugned order does not call for any interference of this Court.
Hence, the writ petition is dismissed. No order as to costs. Consequently, Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
