THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.9543 of 2013 ORDER :

The petitioner, who is the father of the deceased, filed the present Criminal Petition under Section 439 (2) of Cr.P.C. seeking cancellation of bail granted to respondent Nos.2 to 4 vide order dated 26.07.2013 passed in Crl.M.P.No.1197 of 2013 in Crime No.94 of 2013, on the file of the Additional District and Sessions Judge, Narsapur, West Godavari District.

Heard learned counsel for the petitioner and learned counsel for respondent Nos.2 to 4/accused.

A perusal of the material placed before the Court would disclose that respondents Nos.2 to 4 herein are alleged to have committed an offence punishable under section 304-B IPC. The main ground urged by the learned counsel for the petitioner is that the accused are tampering with the evidence and that no cogent reasons are given by the learned Additional Sessions Judge while granting bail to the accused. Learned counsel for the accused submits that police have completed the investigation and filed the charge sheet, as such the question of tampering with the evidence does not arise. As seen from the record, the petitioners were released on bail in the month of July, 2013 and the present petition is filed nearly 1 1⁄2 years there after.

The material on record reveals filing of charge sheet against all the three accused and later on the case was also committed to the Court of Sessions which came to be numbered as S.C.No.254 of 2014 on the file of the Additional District and Sessions Court, West Godavari at Narasapur.
