The present writ petition is filed questioning inaction of the third respondent to exercise his legitimate and statutory duty and to declare the same as illegal and opposed to the provisions of the Constitution of India and consequently to direct the third respondent to take action against respondents 4 and 5 and to give protection to the petitioner and her husband in cultivating and enjoying usufruct in Sy.No.60/31 of Ac.1-25 gts of Ramachandrapuram village, Bayyarama Mandal, Mahabubabad District.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home for respondents 1 to 3. 3.

Learned Assistant Government Pleader for Home, on additional written instructions, dated 29.01.2020, a copy of which is placed on record, submits that as of date the petitioner has not given any complaint to the third respondent and if the petitioner gives any complaint to the third respondent authority, action will be taken as per law. By the said additional instructions, it is stated that based on the complaint given by the husband of the petitioner a case is registered in Cr.No.128 of 2019 under Sections 447, 427 and 506 r/w Section 34 I.P.C by the Garlabayyaram Police Station on 25.10.2019. It is also stated that the investigation in the case is completed and a charge sheet is filed in the said case before the Additional Judicial First Class Magistrate, Yellandu on 16.12.2019 and the case is numbered as C.C.No.513 of 2019 and is posted for appearance of the accused on 14.02.2019.

Recording the above said submissions made by the learned Assistant Government Pleader for Home on behalf of the respondent police authorities, no further orders need be passed in this writ petition. 5.

Accordingly, the writ petition is closed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
