HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION Nos.27589 & 27730 of 2019 COMMON ORDER:

These writ petitions are filed by the same petitioners against same respondent seeking the very same relief. The petitioners neither approached the office of the Advocate nor this Court with clean hands. The attitude of the petitioners in keeping their counsel in dark cannot be appreciated. Therefore, filing of two writ petitions for same relief by suppressing the facts and pendency of other writ petition cannot be appreciated and it attracts Res Judicata. In view of the same, this Court feels that it is not proper in entertaining these two writ petitions.

Accordingly these two writ petitions are dismissed with costs of Rs.10,000/- in each case payable by the petitioners in each writ petition to the Army Welfare Fund, Syndicate Bank, South Block, Defence Head Quarters, New Delhi Branch vide A/c.No.90552010165915, IFSC Code-SYNB 0009055, Branch Code-9055. However, petitioners are at liberty to file fresh writ petition only after complying with the order as to payment of costs.
