THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.27608 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is, therefore, prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in nature of Writ of Mandamus declaring the action of the respondent No.3 in disqualifying the petitioner from contesting the upcoming Municipal elections for a period of three years vide proceedings in No.888/TSEC-L/2015-295, dated 23-062017 under provisions of the Telangana State Municipalities Act, 1965 as arbitrary, illegal, contrary to the settled principles of legal position apart from being voilative of the fundamental rights guaranteed to the petitioners under Articles 14, 19 and 21 of the Constitution of India and consequently set-aside the proceedings in No.888/TSEC-L/2015-295, dated 23-06-2017 and pass such other order or orders as are deemed fit and proper in the circumstances of the case."

Heard Sri Sanjeev Gillella, learned counsel appearing for the petitioner, learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent, learned Government Pleader for Revenue appearing for respondents 2 & 5, Smt. M.Bhagya Sri, learned standing counsel appearing for the 4th respondent and Sri P.Sudheer Rao, learned standing counsel appearing for the 3rd respondent. Perused the material available on record.

When the matter is called, it is submitted by learned counsel for both sides that the issue in the present writ petition is squarely covered by the order, dated 24.06.2019, in W.P.No.12541 of 2019 of this Court. A copy of the same is filed along with writ material papers.

Following the said order and for the reasons stated therein, this Writ Petition is also allowed by setting aside the order impugned. There shall be no order as to costs. 5.

Office to enclose a copy of the order, dated 24.06.2019, in W.P.No.12541 of 2019 to this order.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
