CVNR, J & KVL, J WP.No.34500 of 2016 Dated:04.10.2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed against common order, dated 14.9.2016, to the extent it pertains to Original Application No.3484 of 2016 on the file of the Andhra Pradesh Administrative Tribunal at Hyderabad (for short 'the Tribunal'). After arguing the case, Mr. S.Ashok Anand Kumar, learned counsel for the petitioner, submitted that the petitioner could not raise the issue relating to non-inclusion of three posts, viz., one post of Squadron Commander of Greyhounds, one post of Additional Commandant, Special Armed Force and one post of Additional Superintendent of Police, Armed Reserve in the cadre while making allocation and that, therefore, his client may be permitted to withdraw the Writ Petition with liberty to him to avail a fresh legal remedy before the appropriate forum canvassing this issue.

Learned Government Pleader for Services (Andhra Pradesh) fairly has not objected to this request.

In view of the same, the Writ Petition is dismissed as withdrawn, with liberty to the petitioner in terms of the prayer made. It is made clear that the impugned order of the Tribunal would not come in the way of the petitioner pursuing a fresh legal remedy and that the findings rendered by the Tribunal in

CVNR, J & KVL, J WP.No.34500 of 2016 Dated:04.10.2017 the impugned order shall not prejudice his interests in such litigation.

As a sequel, WPMP.No.42523 of 2016 stands dismissed as infructuous.
