THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.24210 AND 24424 OF 2018 COMMON ORDER The grievance of the petitioner in W.P.No.24210 of 2018, is that the respondent - Sub Inspector of Police, Afzalgunj Police Station, Hyderabad, is interfering with the civil dispute between the petitioner and Anand Nivas @ Anand Nivas Sarma.
The grievance of the petitioner in W.P.No.24424 of 2018 is that the Sub Inspector of Police, Afzalgunj Police Station, Hyderabad is not completing the investigation in Cr.No.320 of 2017, registered against the unofficial respondents 4 to 7 who are Anand Nivas @ Anand Nivas Sarma, Ananth Nivas Sarma, Jagan Nivas Sharma, Mrs. Radhika Sarma. Heard the learned counsel for the petitioners in both the writ petitions.
Learned Assistant Government Pleader for Home fairly submits that in W.P.No.24424 of 2018, the Sub Inspector of Police, is on probation and due to lack of experience, he sent all notices under Section 91/ 160 of Cr.P.C., which are dated 30.10.2017, 12.11.2017 and 13.12.2017 to the petitioner / complainant on 03.01.2018 and subsequently, he was transferred and investigation was entrusted to Circle Inspector of Police. With regard to allegations in W.P.No.24210 of 2018, learned Assistant Government Pleader for Home on instructions, submits that the Sub Inspector of Police, Afzalgung Police Station, never interfered with the civil dispute and sought to dismiss the writ petition.
In W.P.No.24424 of 2018, as the crime registered was of the year 2017, the Circle Inspector of Police, Afzalgunj Police Station, Hyderabad is directed to complete the investigation as expeditiously as possible and file charge sheet in accordance with law.
W.P.No.24210 of 2018 is disposed of directing the respondents not to interfere with the civil dispute and also the life and liberty of the petitioner, except by following due process of law.
With the above direction, both the writ petitions are disposed of. Interlocutory applications pending, if any, shall stand closed. No costs.
