The present writ petition is filed questioning the inaction of the 3rd respondent-Station House Officer, I-Town Godavarikhani Police Station, in not registering the complaint made by the petitioner dated 02.11.2019 sent to the 2nd respondent - Commissioner of Police, Ramagundam Commissionerate, as being illegal and arbitrary. Heard Sri Ch. Venkat Raman, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.
The learned Assistant Government Pleader for Home, on written instructions dated 26.12.2019, submits that the complaint of the petitioner dated 02.11.2019 addressed to the 2nd respondent was forwarded to the 3rd respondent through proper channel for causing inquiry. The learned Assistant Government Pleader further submits that on perusal of the above complaint, it disclosed that already a case was registered in Crime No.54 of 2019 of Godavarikhani Police Station for the offence punishable under Section 420 of the Indian Penal Code, 1860, based on the complaint of one Sri R.V. Narsing Rao, who is the special power of attorney holder of the petitioner and the said case is under investigation for
collection of report from the Revenue Divisional Officer, Peddapalli.
Since the complaint made by the petitioner on 02.11.2019 is relating to the same subject matter, which is under investigation in Crime No.54 of 2019 based on the complaint made by the power of attorney holder of the petitioner, no further action was taken on the compliant dated 02.11.2019.
Having regard to the said submission made, since the Crime No.54 of 2019 of Godavarikhani Police Station is under investigation in relation to the subject issue, no further orders are required to be passed in this writ petition. Accordingly, the writ petition is closed. However, there shall be no order as to costs.
