Dr. M.Ch. Nanditha, v. Sri S. Appala Naidu,
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY C.C. NO.1802 OF 2018
O R D E R
The petitioners in this contempt case are pursuing post-graduation in medicine and they filed W.P.No.20880 of 2018, seeking for a direction to manually revaluate the answer sheets as per their representations. This court by order dated 21.06.2018, without expressing any opinion on merits, directed the competent authority to consider the representations in accordance with law. Complaining that respondents have flouted the order of this court, present contempt case is filed. Learned Standing Counsel for the respondent - University, producing copy of the letter dated 07.08.2018, addressed to him by the Controller of Examinations, submits that the respondents have considered the representations of the petitioners', and as there is no provision for revaluation of the answer scripts, rejected the same, and communicated the proceedings to the petitioners'.
Learned counsel for the petitioners, submit that the petitioners have not received any communication.
In view of the above, as the respondent - University, has complied with the directions of this court by considering the representations of the petitioners', I do not find any contempt on their part, and as the request of the petitioners was rejected, it is open to them to challenge the same in accordance with law.
The respondents are directed to communicate the proceedings to the petitioners within a week, wherein their claim was rejected, if not already communicated.
The contempt case is accordingly disposed of. Miscellaneous petitions pending, if any, shall stand closed. No costs. ------------------------------------------------ A.RAJASHEKER REDDY,J DATE:09-08-2018 AVS
