THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.27708 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the inaction of respondent No.2 in considering the representation of the petitioner, dated 19.11.2018, against illegal allotment of House bearing No.6-2-91 of Mahabubabad Municipality, as arbitrary and illegal and consequently direct the 2nd respondent not to entertain any kind of transaction in respect of H.No.6-2-91.

Heard the learned counsel for the petitioner and the learned Standing Counsel for 2nd respondent-Municipality. 3.

The grievance of the petitioner is that he is the owner and possessor of House bearing No.6-2-91 situated at Mahabubabad Municipality. While so, the respondent authorities are trying to allot the said house in favour of respondent Nos.3 to 6, without there being any right over it. He further submitted that the petitioner also submitted a representation before the authorities concerned on 19.11.2018 in this regard. But, till today, no orders are passed on the said representation.

This Court, after hearing the learned counsel for the petitioner and learned Standing counsel for the 2nd respondent, came to the conclusion that the ends of justice would be met if the writ petition is disposed of with the following direction: The 2nd respondent-Municipality is directed to issue summons to the petitioner as well as respondent Nos.3 to 6 and after affording opportunity to both parties and after conducting

due enquiry, the authorities concerned shall pass appropriate orders on the representation of the petitioner, dated 19.11.2018, in accordance with law. This exercise shall be completed within a period of two (2) months from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ T.AMARNATH GOUD, J 13th December, 2019 YVL
