HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 18615 of 2016 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the fourth respondent in directing the petitioner to stop constructing walls to his shed in his part of private land to an extent of 9 guntas in Survey No.2 part, situated at Thumkunta Village and Grampanchayat, Shameerpet Mandal, Ranga Reddy District, as biased, without jurisdiction and illegal.

It is the case of the petitioner that he is the absolute owner and possessor of the aforesaid property and that he had made construction after obtaining permission from the third respondent. While so, one B. Raj Kumar made a complaint to the fourth respondent alleging that the petitioner has occupied the road and making construction. Based on the said complaint, the fourth respondent issued a notice dated 04.06.2016, to which the petitioner submitted his explanation on 06.06.2016. However, apprehending that the fourth respondent may demolish his shed, the petitioner filed this writ petition. Learned Standing Counsel for the third respondent - Grampanchayat submits that the fourth respondent will not take any steps for demolition without considering the explanation submitted by the petitioner.

In the light of the submission made by the learned Standing Counsel, the writ petition is disposed of with a direction to the fourth respondent to consider the explanation submitted by the petitioner pursuant to the notice dated 04.06.2016 and pass appropriate orders thereon in accordance with law. Till such time, the respondents shall not demolish the construction made by the petitioner. It is also made clear that the petitioner shall not make any further constructions in the subject property in the interregnum period.
